Financial support is a critical aspect of raising a child. For young families navigating the complexities of child support, understanding the legal framework is essential. This guide will provide an overview of child support agreements, focusing on how they work and how family law services can help.

What is a Child Support Agreement?

A child support agreement is a legally binding document that outlines the financial responsibilities each parent has towards their child or children. This agreement can be reached privately or with the help of family law services. It’s important to understand that these agreements don’t just cover financial contributions. They also cover things like the child’s education, healthcare, and general well-being.

Types of Child Support Agreements

There are two main types of child support agreements in Australia:

Binding Child Support Agreement:

  • Formal Agreement: The binding nature of this agreement means that, once signed, it cannot be changed unless both parties agree to the amendments or a Court intervenes. Further, both parties are required to receive independent legal advice before signing.
  • Inclusions: This agreement covers a range of expenses, including but not limited to school fees, extracurricular activities, and healthcare costs.

Limited Child Support Agreement:

  • Less Formal: This agreement does not require that the parties receive independent legal advice before signing, which alters the binding nature of the document. However, it must be registered with the Department of Human Services (DHS) to be enforceable.
  • Duration: The limited nature of this agreement means that the parties can enter into the same for a period of up to three (3) years.
  • Termination: Contrary to Binding Child Support agreements, this agreement can be terminated by entering into a new agreement or if the parties agree for the termination in writing.

How to Create a Child Support Agreement

Creating a child support agreement involves several critical steps:

1. Assess Your Financial Situation:

Both parents need to assess their financial situations. This includes income, expenses, and the financial needs of the child. This information will assist in determining the amount of child support required.

2. Negotiate the Terms:

Once the financial situation is clear, parents should discuss and agree on the terms of the child support. This can include the amount to be paid, the frequency of payments, and what specific expenses the support will cover. Having an experienced solicitor who specialises in family law services can be beneficial in ensuring that the agreement is fair and legally sound.

3. Draft the Agreement:

After reaching an agreement, the agreement should be drafted into a written agreement. A family lawyer can help draft a legally binding document that reflects the agreement.

4. Seek Legal Advice:

Before finalising the agreement, it’s important to seek legal advice to ensure that both parties understand their rights and obligations under the agreement.

5. Register the Agreement:

Finally, the agreement should be registered with the DHS. This makes it enforceable and ensures that both parties comply with the terms. If any issues arise, the DHS can assist in enforcing the agreement.

Reviewing and Modifying a Child Support Agreement

Circumstances can change, so it’s important to review the child support agreement regularly. Changes in income, employment, or the child’s needs may require adjustments to the agreement. Both types of agreements allow for modifications, though the process differs.

Binding Child Support Agreement:

  • Can only be modified by consent of both parties or by a Court Order.

Limited Child Support Agreement:

  • Can be modified every three (3) years in accordance with a change in circumstances.

Benefits of a Child Support Agreement

Having a clear child support agreement in place offers numerous benefits:

Clarity and Security:

  • Both parents know exactly what is expected in terms of financial contributions. This can create a sense of stability for the child.

Flexibility:

  • Depending on the type of agreement, there is flexibility to adjust the terms as circumstances change.

Legal Protection:

  • A registered agreement is legally enforceable, ensuring that both parties adhere to the terms.
